Right of withdrawal

This policy applies to consumers who enter into a paid contract with us for digital content, for example the purchase of premium currency for Zephnex (see Terms, sections 8 and 9). A consumer is any natural person who enters into a legal transaction for purposes that cannot predominantly be attributed to their commercial or self-employed professional activity.

Note on App Store and Google Play: For purchases on the web, in the desktop app and in apps distributed directly by us we ourselves are your contracting party (Stripe processes the payment for us); this policy applies to them. If the purchase is made through the Apple App Store or Google Play and Apple or Google is your contracting party under the terms of the purchase process, withdrawal and refunds are governed by the policy and contact channels stated there; periods and procedures stated there take precedence. This withdrawal policy applies to all contracts in which we ourselves are the contracting party.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day of conclusion of the contract.

by means of a clear statement (e.g. a letter sent by post or an email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient that you send the notice of exercising the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we must reimburse all payments we have received from you without undue delay and at the latest within fourteen days from the day on which we received the notice of your withdrawal from this contract. For this reimbursement we use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees because of this reimbursement.

Early expiry of the right of withdrawal for digital content

The right of withdrawal expires for a contract for the supply of digital content not supplied on a tangible medium (for example credited premium currency) if we have begun performance of the contract after you have expressly agreed that we begin performance before the withdrawal period expires, and you have confirmed your awareness that by your consent you lose your right of withdrawal once performance begins (§ 356(5) BGB). Performance begins when the premium currency is credited to your game account. If you have already used premium currency, withdrawal is excluded to the extent that the right of withdrawal has expired.

The right of withdrawal expires only if your express consent and your confirmation of awareness were actually given in the purchase process. If either is missing, the right of withdrawal continues to exist. For purchases on the web, in the desktop app or in an app distributed directly by us we obtain both before payment by a mandatory checkbox on the payment page, store the time and the payment process, and additionally confirm the waiver to you by email. If the purchase is made through Apple or Google, this consent may be obtained in that provider's purchase process.
